Official Rules for Rocky Mountain High’s Rock The Road Trip Contest – Dallas

No Purchase Necessary. A Purchase Will Not Increase Your Chances Of Winning.

Rock the Road Trip Dallas is only open to bands or artist that reside in Texas, Oklahoma, Louisiana or Arkansas

The Contest is open only to legal residents age 21 or above.

The following individuals are not eligible to enter: (a) Individuals or bands who are signed to an exclusive recording agreement with a record label or publisher; (b) employees of Rocky Mountain High Brands  Inc., their subsidiaries and affiliates (collectively “RMHB”); and (c) the immediate family (spouse, parents, siblings, and children) and household members of those employees.

Contest entries begin at 10:00 AM CT on August 8, 2016 and close at 8:00 PM CT on October 16, 2016 (the “Entry Period”). Entries received outside of the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Contest.
During the Entry Period, visit www.rocktheroadtrip.com (the “Contest Site”), and complete the entry form. You may enter the Contest as an individual or on behalf of your band. If you enter on behalf of your band, the band may consist of no more than six (6) individuals and each individual must meet the eligibility requirement set forth above. On the entry form, you will be required to provide links to your/your band’s website or social media page and upload one original song with band name, song title and city and state your band resides in. There is a limit of one (1) entry per person, whether you enter as an individual or on behalf of your band, and one (1) entry per band, regardless of the number of members.

By entering, you, or if you are entering on behalf of your band, you and each band member, indicate your full agreement to these Official Rules and Sponsor’s decisions regarding the Contest, which are final and binding. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.

Please make sure that submitted songs do not: (a) violates anyone’s rights, including, but not limited to, copyrights or trademark rights; (b) portray Sponsor or its products in a negative light; or (c) conflict with Sponsor’s image.
Between October 17, 2016 and November 1, 2016, Rocky Mountain High Brands will select 5 potential showcase winners based on the following Judging Criteria, weighted equally: (a) song writing strength (b) musicianship (c) votes collected from the website.  The odds of being selected for the showcase round depend on the relative performance of all entrants and the number of eligible entries received. Sponsor will attempt to notify the showcase winners via e-mail on or about November 2, 2016.
Each potential winner — including each member of his/her band, if applicable — may be required to sign and return a Declaration of Eligibility, a Publicity and Liability Release, an artist agreement, and (if required) tax documentation within ten (10) days. Sponsor reserves the right to disqualify a potential winner (and his/her band members) if: (a) Sponsor does not receive all of the required documents on time; (b) any band member fails to comply with theses Official Rules; or (c) any band member rejects the prize. In the event a potential winner is disqualified, Sponsor may, in its sole discretion, select an alternate potential winner based on the Judging Criteria. The potential winner (all band members) must attend a photo shoot including product placement of Rocky Mountain High beverages that will be used for promotion however Rocky Mountain High sees fit.

The winning bands or artists must arrive at all scheduled events on time. Failure to do so many result in disqualification from the contest.

The winner of Rock Out with Rocky Mountain High will receive a three-song studio package for his/her band (if applicable) at Empire Sound Studios located in Carrollton, TX with music producer Alex Gerst. Alex will act as studio engineer and music producer on all three songs and provide the finished recordings to the band. Rocky Mountain High Brands, Inc. will also be provided with the recordings to use on their website or for promotional purposes. The recording sessions will be scheduled directly with Alex Gerst and must be completed by March 31, 2017. The approximate retail value of the three-song recording sessions is $3,000.

The winner will also receive a one month supply of assorted Rocky Mountain High beverages, a promotional vinyl banner with the band’s name and Rocky Mountain High sponsorship, a professional photo shoot for the band, including Rocky Mountain High product placement and an opening slot at a major Dallas venue within 3 months of the contest concluding.

The value of the prize may be treated as income to a winner and thus the winner (including all band members, if applicable) may be responsible for payment and reporting of any and all applicable taxes. For tax purposes, the value of the prize will be divided equally between all band members. We encourage you to consult your tax advisor to determine how winning this prize may affect your tax obligations under applicable laws.

All travel, accommodations and meal expenses, as well as all transportation of gear and equipment is the sole responsibility of the winning band or artist.
In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prize according to the Judging Criteria from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision.

By participating in the Contest, you agree to release and hold harmless Sponsor, to the fullest extent permitted by applicable law, Rocky Mountain High Brands, Inc., their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, special, punitive, consequential, direct, or indirect damages, or for loss of opportunity or data, whether in an action in contract, tort, statute, or otherwise, even if informed of their possibility.

You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules.
The winners of the showcase round will be posted on the Contest Site on or about November 1, 2016. Rocky Mountain High Brands will also attempt to contact winners via email. The final winner of the contest will be announced at the conclusion of the showcase round occurring in late November.
Your personal information will be treated in accordance with the Privacy Policy posted on the Contest Site. You irrevocably authorize Sponsor, its agents, and its subsidiaries, as stated in Section 5 the Personal Data Protection Act 25,326 (“PDPA”), and as a condition of participating in the Contest, (1) to disclose your personal data, including your address, images, and voice (your “Personal Data”), for advertising purposes, in any media, without the right to any compensation, during the term of the Contest and for ten months after its completion; and (2) to periodically send you advertising on products or services. You also acknowledge and agree that Sponsor, its agents, and its subsidiaries may process your Personal Data by virtue of your participation in this Contest in records or Sponsor’s data banks. Thus, you release Sponsor from any liability for misuse by third parties of your Personal Data. Sponsor will not assign or license your Personal Data without your express consent, as required under Texas law. You, as the holder of Personal Data, have the right to access your personal information in intervals no shorter than six (6) months entirely free of charge, unless there is a specified legitimate interest, as agreed by the holder and as established in Section 14, paragraph 3 of the PDPA. The National Data Protection Authority, in its role as enforcer of the PDPA, may investigate any complaints or reports related to alleged non-compliance with the established rules on the protection of personal data.
